Service Contract for Using the Gingr Escort Service

Service contract for using the Gingr platform: payment, creditworthiness, data protection, reminders and legal information.

1. Contracting Parties

(hereinafter referred to as "service provider")

Customer
(hereinafter referred to as "customer")

2. Subject of the Contract

The service provider grants the customer access to the "Gingr" platform to make use of escort services.

By accepting this contract, the customer is able to contact registered escorts via the platform.

3. Payment Terms

The customer has chosen the payment option "pay by invoice".

By selecting this option, the customer enters into a binding agreement with the service provider.

Services on the platform are only unlocked after the agreed amount has been paid in full to the service provider's account.

3.1. Credit Check and Data Transfer

To provide the "pay by invoice" option:

• the service provider transmits the customer's data to the third-party provider CRIF
• CRIF carries out a credit check to determine the maximum credit limit

By agreeing to these terms, the customer consents to this data transfer and check.

3.2. Data Protection Compliance

The service provider ensures compliance with:

• the General Data Protection Regulation (GDPR)
• the Swiss Data Protection Act (DSG)

4. Reminder Process

If the customer does not pay the invoice on time, the following reminder process applies:

• 1st reminder, day 10: notification by in-app message and email, no fees
• Phone reminder, day 15: phone call (2 attempts), no fees
• 2nd reminder, day 20: notification by in-app, email and SMS, CHF 20 reminder fee
• 3rd reminder, day 25: notification by in-app, email, SMS and letter by post, CHF 50 reminder fee

If no payment is made within 5 days of the 3rd reminder, debt collection proceedings are initiated.

All additional costs arising from these proceedings are borne by the customer.

5. Services and Usage Rights

After successful payment, the customer gains access to the agreed services on the platform.

Sharing access credentials with third parties is expressly prohibited.

6. Liability and Warranty

The service provider is not liable for the conduct of the registered escorts.

The customer undertakes to comply with the platform's general terms of use.

7. Contract Duration and Termination

This contract takes effect as soon as the customer accepts the terms.

It ends automatically once the agreed services have been provided and no further bookings are made.

Early termination is excluded unless required by law.

8. Final Provisions

8.1. Applicable Law and Place of Jurisdiction

This contract is governed by Swiss law.

The exclusive place of jurisdiction is Rotkreuz, Switzerland.

8.2. Data Protection

The service provider undertakes to fully comply with the GDPR and the Swiss DSG in all data processing.

8.3. Notice in the Event of Late Payment

In the event of late payment, the account is blocked and debt collection proceedings are initiated.

All resulting costs are charged to the customer.

Amendments or additions to this contract must be made in writing.

Should any provision of this contract be invalid, the remainder of the contract remains fully valid.

9. Legal Validity

This contract is legally binding even without a signature, as soon as the customer agrees to the terms by using the platform.
