Is sex in the car illegal? The legal situation in Switzerland
The key points in brief
- Sex in the car is not illegal in Switzerland. No article of law covers it.
- It only becomes a criminal matter if someone witnesses it against their will and files a criminal complaint within three months. Then a fine under Art. 198 of the Swiss Criminal Code (SCC) is possible.
- While driving, it becomes a road traffic matter, in the worst case with a licence suspension.
- In a rental car the criminal law is the same. At most, a cleaning fee comes on top.
- For paid encounters, the cantonal prostitution regulations apply in addition.
The details follow below. Which positions for sex in the car actually work is covered in a separate article.
Is sex in the car illegal in Switzerland?
No. You can have sex in a car as long as nobody is forced to watch.
The Swiss Criminal Code has no offence covering sex in the car, outdoors or anywhere else in public. The only provision that can apply is sexual harassment under Art. 198 SCC. Under it, anyone who performs a sexual act in front of a person who does not expect it, and causes offence by doing so, commits an offence. So two things have to come together: someone who happens to watch, and the fact that it offends them. A couple in a darkened car on an empty car park has neither.
Art. 198 is prosecuted only on complaint, so the police do not investigate on their own. As long as nobody feels disturbed and reports it, nothing happens at all. The penalty the law provides is a fine, under Art. 106 SCC at most 10,000 francs. In practice it stays far below that.
Anyone searching online for the topic often ends up on German guides. In Germany, § 183a of the German Criminal Code applies, causing public offence, and there up to one year in prison is possible. That has nothing to do with the legal situation in Switzerland.
What happens if you get caught having sex in the car?
Usually not much. Without a criminal complaint there are no proceedings.
If a police patrol comes by, it normally checks briefly that both of you are there willingly and then moves on. It only gets more serious if someone files a complaint. Anyone who feels disturbed has three months to do so under Art. 31 SCC. In that case the public prosecutor opens proceedings, which normally end with a penalty order and a fine.
Almost all guides leave out something important: fines of up to 5,000 francs are not entered in the criminal record. A conviction for sex in the car therefore does not appear on any criminal record extract, unless the fine is above that amount. For a first offence with no further circumstances, that is hard to imagine.
It gets serious as soon as children under 16 are involved. Anyone who intentionally involves a child in a sexual act, including by letting the child watch, falls under Art. 187 SCC. That is an offence prosecuted ex officio: the authorities investigate on their own initiative, and a prison sentence is possible. The car park next to the playground in the afternoon is therefore off the list.
When does it count as exhibitionism?
When it happens outside the car and strangers are meant to see it. Two people inside the car is not exhibitionism.
Art. 194 SCC punishes exhibitionist acts, meaning deliberately showing one's genitals to people who do not want to see them. Sex on the bonnet next to a busy road can fall under it, sex in the car with the doors closed does not. Since the revision of sexual criminal law on 1 July 2024, exhibitionism in its basic form is also only a contravention punished with a fine. A monetary penalty applies only in serious cases. Wherever a text still mentions 180 daily penalty units, it is based on the old version.
Is sex while driving allowed?
No. As soon as the car is moving, the Road Traffic Act (RTA) is what counts, not sexual criminal law.
Under Art. 31 RTA, the driver must be in control of the vehicle at all times. Anyone receiving oral sex at the wheel, or with one hand somewhere other than the steering wheel, is not. In minor cases there is a fine under Art. 90 para. 1 RTA. If someone is seriously endangered, it is a gross violation of traffic rules under Art. 90 para. 2, with a monetary penalty or a prison sentence of up to three years. On top of that come administrative proceedings. For a serious offence the licence is suspended for at least three months under Art. 16c RTA, for a moderately serious one for at least one month under Art. 16b.
So oral sex in the car is not illegal in itself. In a moving car it is, even when nobody is watching. In Switzerland, a glance at your phone at the wheel is already enough for a fine. Sex while driving is judged considerably more strictly.
Sex in a car park: what fines are there besides the Criminal Code?
Depending on the municipality and the car park, two further layers come into play: the municipal police regulations and the parking rules.
Many municipalities ban breaches of decency in their police regulations. Bülach, for example, prohibits causing public offence or breaching decency and morals in Art. 4 of its police ordinance and punishes it with a fine. The General Police Ordinance of the City of Zurich contains no comparable article. There, the only remaining issue is noise, since disturbing behaviour outdoors is banned during night-time quiet hours. As the Beobachter rightly notes, such regulations differ from one municipality to the next. So there is no general answer. If you want to be sure, read the regulations of the municipality where the car is parked.
Then it depends on the car park itself. An official car park after closing time is no problem, a forest road is. Art. 15 of the Forest Act prohibits driving motor vehicles on forest roads, and under Art. 43 fines of up to 20,000 francs are possible. Where a no-entry sign is posted, there is a fixed-penalty fine. That has nothing to do with sex, but it affects precisely the people looking for a secluded spot. Quiet places that are also legally fine are listed in the article on places for outdoor sex.
Is sex in a rental car allowed?
Yes. Under criminal law it makes no difference who owns the car.
For Art. 198 SCC, the vehicle registration is irrelevant. With a rental car, however, the contract with the rental company comes on top. I know of no Swiss provider that explicitly bans sex in the vehicle in its terms. What all of them do regulate is that the car has to be returned clean. Mobility charges for a special cleaning at least 100 francs depending on the effort, plus 140 francs per hour for particularly heavy work. The traditional car rental companies charge a similar amount for interior cleaning. If you return the car in the same condition you got it, you pay nothing.
Is outdoor sex illegal in Switzerland?
No. The same rule applies as in the car: without unwilling onlookers there is no offence.
Whether in the forest, by the lake or in the car, Art. 198 SCC is always the benchmark. The only difference is how easily you are seen. In the car you have doors and windows, in a clearing you do not. Which places in Switzerland have proven themselves in practice and what to look for when choosing one is covered in the article on outdoor sex.
Does this also apply to a meeting with an escort?
Only partly. With paid sex, a second legal layer comes into play.
Alongside Art. 198, Art. 199 SCC also becomes relevant. Under it, anyone who breaches cantonal regulations on the place, time or manner of prostitution is punished. These regulations differ by canton and city. In the City of Zurich, street prostitution is only permitted in licensed zones, and sex in the car is provided for there solely at the Depotweg street-sex site. How the Zurich prostitution ordinance works in detail is described in a separate article. Which other zones exist is covered in the Escort Guide on the legal situation in Switzerland.
For a booked escort meeting, a car in a public space is therefore not a good choice. For you as the client it does not immediately become a criminal matter. The escort, however, moves into a grey area of her permit. That is why most of them suggest a hotel room or a meeting at their place in response to such requests. What hotels allow when it comes to escorts is clearly regulated. Whether a client commits an offence by booking at all does not depend on the location. What matters is age, consent and coercion.
Frequently asked questions
Can you have sex in a car parked in a public car park?
Yes. The car park changes nothing about the legal situation. What matters is whether someone watches against their will and files a complaint. An empty car park after closing time is therefore legally unproblematic. A full car park on a Saturday afternoon is a different story.
Is oral sex in the car illegal?
In a stationary car the same applies as for any other sexual act: it is not illegal as long as nobody is watching. In a moving car it breaches the Road Traffic Act. That can result in a fine or even a licence suspension. On the subject of protection, it is worth looking at the safer sex standards.
Can I get a criminal record for sex in the car?
Only if the fine is above 5,000 francs. Contraventions with lower fines are not entered. For a first offence with no further circumstances, the fine is considerably lower.
What is the difference between sexual harassment and exhibitionism?
Art. 198 SCC concerns sexual acts that someone witnesses against their will. Art. 194 SCC concerns deliberately showing one's genitals to strangers. Sex in a closed car can at most fall under Art. 198. Since 2024, both are contraventions in their basic form, punished with a fine.
In summary
- Sex in the car is allowed in Switzerland. It only becomes an offence if a person who had to watch against their will files a criminal complaint.
- The fine under Art. 198 SCC is at most 10,000 francs. If it is below 5,000 francs, it is not entered in the criminal record.
- Exhibitionism under Art. 194 SCC only covers deliberately exposing yourself to strangers, not sex between two people in a car.
- While driving, the Road Traffic Act applies. A fine is possible, and for a gross violation a monetary penalty and a licence suspension.
- Police regulations and parking rules are a matter for the municipalities. Forest roads are off limits.
- In a rental car nothing changes under criminal law. At most, the cleaning fee comes on top.
- For paid encounters, the cantonal prostitution regulations apply in addition. A hotel or an incall is the clean solution.
