Working legally as an escort as an EU citizen: permits explained

Sex work is legal in Switzerland. Still, many women from the EU work here without a valid notification or permit. Not out of bad intent, but because the rules are scattered: some sit in the directives of the State Secretariat for Migration, some in cantonal fact sheets, all of it in official jargon. This article translates that.

Can I work as an escort in Switzerland as an EU citizen?

Yes. As a citizen of an EU or EFTA state you can work legally as an escort in Switzerland, provided you are of age and working of your own free will. The free movement of persons makes it possible.

The first key question is: are you employed or self-employed? That determines whether an online notification is enough or whether you need to apply for a permit. What the two models mean in practice is explained in the guide chapter on the E1 and E2 employment contracts.

How does the notification procedure work for employees?

As an employee, you do not need a permit for up to 90 working days per calendar year. An online notification via the notification procedure of the State Secretariat for Migration (SEM) is enough. And it is not you who files it, but your employer, at the latest one day before you start work.

Important: the 90 days are actual working days, not days of stay. If you work three days a week, that carries you well past half a year.

If you want to work on a permanent basis (E1) or for more than 90 days, you need a residence permit. The good news: with an employment contract, you are entitled to one as an EU citizen, issued as an L or B EU/EFTA permit depending on the length of your contract. It automatically allows you to work; there is no separate work permit procedure for EU citizens. And you may work anywhere in Switzerland and change jobs.

Does the notification procedure work for the self-employed too?

Yes, but the hurdles are considerably higher, and this is where most mistakes happen. In the erotic industry, the notification procedure for the self-employed only applies if you work outside an establishment and nobody gives you instructions. If you work in a club or studio, you count as employed under immigration law. The operator then counts as your employer, even if all they do is rent you a room.

For the notification as a self-employed person you need more than one form:

1. the A1 form from the social insurance body in your home country as proof of self-employment,
2. a signed rental contract, and
3. details of where you advertise your services.

The notification must be filed eight days before you start working. And beware: the first confirmation email only means your notification has arrived. It has not been checked yet. The counselling centre Xenia explains clearly where you may work with which permit (page in German).

The authorities look closely at the self-employed; the keyword is bogus self-employment. Being self-employed in your home country does not guarantee that Switzerland sees it the same way. The Canton of Bern describes the requirements for self-employed sex workers step by step (in German).

How do I get a B permit as a self-employed escort?

Through your commune of residence, with complete documents and a personal interview. If you want to work self-employed for more than 90 days, the route leads via a B residence permit for the self-employed.

The process: you register with the residents' office of your commune. It forwards your application to the migration authority. Then you are invited to an interview. If you can prove your self-employment, you receive the B permit. Typical documents are a valid passport or ID, the rental contract, health insurance and registration with the AHV (Swiss social security) as a self-employed person. There is no legal entitlement here. Unlike the employment route, the permit is at the authority's discretion. One more reason to walk into that interview well prepared.

What applies to women from non-EU countries?

The honest answer: without an existing residence permit, there are practically no permits for third-country nationals in the sex industry. Cross-border commuter permits are not issued for sex work either. Anyone promising you otherwise usually wants to exploit you.

It is different if you already hold a B or C permit, for example through family reunification. Then the normal rules for gainful employment apply. The UK is a special case: since Brexit it counts as a third country, but under the services mobility agreement between Switzerland and the United Kingdom, access for the self-employed remains eased for up to 90 days until the end of 2029.

What else applies at cantonal level?

The permit is only half the story. Several cantons have their own registration or licensing duties for sex work, independent of immigration law. In Zurich this is governed by the Prostitution Trade Ordinance (PGVO), in Bern by the Prostitution Trade Act (PGG). Lucerne also has its own rules in its trade police legislation.

Important: Inform yourself in the canton where you work before you start. Not once a letter from the authorities arrives.

Do I need a new notification for every canton?

The notified days are tied to the place of work you stated in the notification. If you change location, you must amend the notification. With an L or B permit as an employee, on the other hand, you may work anywhere in Switzerland.

What happens if I work without a notification or permit?

You are violating immigration law. Possible consequences are fines and removal from Switzerland, in serious cases an entry ban. Your employer is liable to prosecution too. The short-term earnings do not justify that risk.
